Terms and conditions.

Thank you for choosing Consta Creative to capture your project. Below are the terms and conditions that govern our services:

  1. Ownership of Content: The videographer business shall exclusively own all rights, title, and interest in the content captured and edited for the client. The content includes but is not limited to video footage, audio recordings, and images. The client is prohibited from reproducing, distributing, or using the content without the videographer's express written consent.

  2. Project Completion: The project is considered completed when the final product is delivered to the client. This includes any revisions or changes requested by the client.

  3. Duration of Storage: The videographer business shall store the content for a period of one year after project completion. After this period, the content shall be deleted from our storage systems. The client is advised to make a backup copy of the final deliverables.

  4. Payment: The client shall pay the videographer business the agreed-upon fee for services rendered. Payment terms may vary depending on the project and the client's status with the videographer business. For larger projects, the videographer business may require a deposit of 50% of the total fee to secure the booking. Ongoing clients may be eligible for a recurring account with payment due upon receipt of invoice. The client shall pay all fees within the specified payment period, which shall not exceed 30 days from the date of invoice.

  5. Cancellation: In the event of cancellation by the client, the client shall provide written notice to the videographer business as soon as possible. The client shall be liable for any costs incurred by the videographer business up to the date of cancellation.

  6. Liability: The videographer business shall not be liable for any damages, loss, or injury arising from the client's use of the content. The client shall indemnify the videographer business against any claims or damages arising from the use of the content by the client.

  7. Privacy: The videographer business shall respect the privacy of the client and their guests. The videographer business shall not disclose or sell the content to any third parties without the client's express written consent. However, the videographer business reserves the right to use any of the content for its own use and marketing purposes, including but not limited to, display on the videographer's website, social media channels, or promotional materials. By engaging our services, the client agrees to allow the videographer business to use the content for its own use and marketing purposes. If the client wishes to restrict the use of the content for marketing purposes, they must notify the videographer business in writing prior to the start of the project.

  8. Dispute Resolution: Any dispute arising from this agreement shall be resolved by negotiation between the parties. If negotiation fails, the dispute shall be referred to arbitration in accordance with the laws of the state.
